Disclosure of Previous Convictions

Employees at Resolve are subject to the Health and Social Care Act 2008, and will be subject to a Police Record Check through the Disclosure and Barring Service (DBS). As an organisation using the Disclosure and Barring Service (DBS) to assess applicants' suitability for positions of trust, Resolve complies fully with the DBS code of practice and undertakes to treat all applicants for positions fairly. It undertakes not to discriminate unfairly against any subject of a Disclosure on the basis of a conviction or other information revealed.

The nature of work at Resolve allows us to ask questions about a person's entire criminal record, including "spent" and "unspent" convictions as defined in the Rehabilitation of Offenders Act 1974. Please declare all criminal convictions, whether spent or not, charges, whether proceeded with or not, and warnings and cautions.

A conviction will not necessarily bar an applicant from employment. This will depend on the nature of the position, the offences and the circumstances applying to the offences. However, failure to disclose an offence will lead to dismissal.

Employees will be required, as part of their contract of employment, to declare any convictions, cautions or bindovers which occur during their employment with Resolve. Employees will be subject to DBS checking on a three yearly cycle.
